Two main types of applications can be made when you are looking for a protective order and we can and will help you with either or both depending on your needs for protection.
The first is a Non-Molestation order, this will help you if you believe you have been a victim of domestic abuse (please see our section on domestic abuse support). When someone is in a situation where they require immediate protection from a partner, ex-partner, or family member, they are then able to apply for a court order called a non–molestation order which will protect them from abusive or harmful behaviour from that person. If you feel there is an immediate threat to you and/or your children, we will help you fill out an urgent application so you can feel a lot more at ease with the future ahead.
The other protective order you can obtain is an Occupational Order, this is where the court decides who should live in, or return to, the home or any part of it. So, this means the order will enforce a party’s right to the property if this is the case and also exclude a party’s right to the property if this is also needed. When you apply for this order, you need to make sure you are in the category of ‘associated persons’. Some examples of which are people who are or have been married to each other, are or have been in a civil partnership with each other, or people who are or have been cohabitants. If you are unsure if this includes you, we can help you to understand your position.
